 Do you know your responsibilities with working safely at heights?

(1) A person conducting a business or undertaking at a workplace must, under part 3.1, manage risks to health and safety associated with a fall by a person from one level to another that is reasonably likely to cause injury to the person or any other person.

In other words, there is no longer a minimum height.

As soon as someone is working off the ground, a risk assessment must be completed and the above rule be applied.

Who is responsible for workplace safety and minimizing this risk and if a fall occurs who is liable?

The person responsible for workplace safety is known as the PCBU or Person Conducting a Business or Undertaking. This can mean a sole trader, partner in a partnership, contractor, organisation, school, company – both private and public – and can include managers, foremen, directors and business owners. If you are responsible for organizing the work to be done then you may be considered the PCBU.

As the PCBU you are responsible for identifying appropriate risk management strategies and work through the hierarchy of control as outlined in section 79(3) of the Regulation which states:

The person provides adequate protection against the risk if the person provides and maintains a safe system of work, including by—

(a) providing a fall prevention device if it is reasonably practicable to do so; or

(b) if it is not reasonably practicable to provide a fall prevention device, providing a work positioning system; or

(c) if it is not reasonably practicable to comply with either paragraph (a) or (b), providing a fall arrest system, so far as is reasonably practicable.
